In the United States an estimated 122-129 million tons of coal ash waste is generated per year, with proportions of the coal ash being used for landfills, or surface impoundment (storage) sites across 36 states. Mountaintop mining contributes to an exponential amount of coal ash waste and has been directly cited for releasing insidious toxins into the environment, a direct effect from the blasting of mountains as part of the surface mining process. Currently coal plays an integral role in US energy policy with government statistics reporting over 1 billion tons of coal used for electric power in 2007. As energy consumption, and efficiency has been brought to the forefront of economic policy, and the decision making strategies used by the current administration. The Fourth Circuit Court of Appeals made a controversial decision that strayed away from the direction of president’s policies with the allowance of over 100 additional mountaintop removal mining permits. The decision returned mountaintop mining to the energy debate, as a result of the extent of hazardous substances that are leaked, and absorbed into the soil, streams and wetlands from carbon coal ash.

While federal laws establish national minimum standards for the protection of the environment, these laws generally provide states with a mechanism by which to establish stricter standards than those enforced at the federal level. However, this is not the case with regard to the regulation of emission standards for mobile sources of air pollution. In fact, Title II, Section 209(a) of the Clean Air Act specifically prohibits states from “adopt[ing] or attempt[ing] to enforce any standard relating to the control of emissions from new motor vehicles or new motor vehicle engines….” There is, however, an exception to the prohibition outlined in Section 209(a) of the Clean Air Act. Specifically, Section 209(b) provides that the Environmental Protection Agency’s (EPA) “Administrator shall … waive application of this section [Section 209(a)’s prohibition] to any State which has adopted standards for the control of emissions from new motor vehicles or new motor vehicle engines prior to March 30, 1966, if the State determine that the State standards will be, in the aggregate, at least as protective of public health and welfare as applicable Federal standards.”
